[/ QUOTE ] Remember, he was also charged with raping another girl (found not guilty in the same trial where he was convicted of the consensual oral sex) at the party. Not consensual sex. Rape. Maybe the DA considers it his job to nail someone who he thinks is a rapist, even if it is on an unrelated charge. |

This just seems like another case of institutionalized racism. Stuff like this changed my mind about going to law school - the judicial system is screwed up.
Anyone have any ideas on how to change the "rules of the game" instead of playing the game by the existing rules? |

13-yr old brains aren't fully developed and are incapable of making choices like that while in full cognition of the possible consequences. Any psychiatrist or psychologist can point you to the physical differences and changes in the brain from 13 to 21, lotsa medical lit on the subject.
Why aren't 13-yr olds allowed to sign contracts, employment or otherwise that are 'consensual.' Put differently, if a 19-yr old can get BJs from a 6/7th grader, why not a 21-yr old? A 30-yr old? 45? 'Consensual' doesn't make it right. You can consensually buy heroin from someone over 21 and freebase it/inject/smoke it but the law still frowns on that stuff. To the Swedes, enjoy paying 90% income tax, here we have a real democracy instead of phony proto-monarchy/parliament, and if you don't want to live in GA you just hitch up the trailer and move N, S or West. Glad the let the kid out. |

[/ QUOTE ] im pretty sure, but could be wrong, but didnt the video tapped evidence show that he did not, infact, have sex with the girl (the one who cried rape), and that she gave her consent to the guys she did have sex with? why does it matter, then, that he was also charged with raping a girl, if its proved that he REALLY REALLY didnt? isnt that like being accused of robbing a store, proving you weren't there, then being charged with littering or something? i mean i know what your saying, that maybe the DA sees this as a rapist who got off on a technicality, but then, how is the DA NOT in the wrong here? i never studied law, so really, correct me, im trying to figure this whole thing out. also, im pretty sure he didnt take the plea bargain because of a younger sister that he wouldnt be able to see as a result. |

Actually what pisses me off in this case is that even though the kid was pardoned, they are still trying numerous ways to leave the door for future "laws" like this to be prosecuted - they won't declare the law itself invalid, but the punishment "cruel and unusual" and arguments by the Supreme Court that there is certainly a "compelling state reason" to regulate kids having sex prematurely. I think that last interpretation goes too far in that it's not focused on protecting non-consensual sex between kids and adults, but is rather a political attempt so that prigs can continue legislating morality and sodomy in an "above-board" fashion. |
