I got to ride with her many times when I was younger. Believe me, 99% of the people that think they can "beat" the cops lose. In theory what you're saying should be true but it isn't. Who do you think the courts are going to believe...the cop or the guy who was driving like a maniac, speeding, carrying false ID, in possession of illegal drugs and paraphernalia and tested positive? He got pulled over on a traffic stop the other day and gave the cop some grief. The friend's brother turns out to know the cop. The cop says he almost maced my friend because he thought he was being "aggressive." My friend said he wished he had so he could cash in on a lawsuit. I said the cop would probably just say my friend lunged at him. "It's my word against his," my friend said. "Exactly," I said. |

[/ QUOTE ] It is very likely in this particular instance there was probable cause and a legal warrantless search was going to occur anyway. However, there are many other instances when police officers will attempt to search your vehicle and you should say no. It isn't any sort of battle to "beat" the police, even if you have nothing to hide you should say no to a search because it takes forever and they go through all your [censored] until they find something. |

I'm just saying cops are trained to be straightforward, somewhat suspicious types. In order to be good street/traffic cop this is necessary. So to expect a cop to distinguish between pakastani and arab is ludicrous. To expect him to view a 19 year old arab driving a 2007 beamer with 50k in a duffle bag and false Pakastani ID as a pokah balla is equally ludicrous. |

This is my first post, so bear with me, please. I must disagree with a statement in this thread. A number of fairly good lawyers will tell you to take any sobriety test offered, and then they would try and beat the test in Court. In the state I live in, (and I am a lawyer, but not a DUI attorney), a refusal to take a DUI test is an automatic license suspension, no questions asked and the appeal process is a bitch. Most DUI attorneys I know actually encourage sobriety tests and others because it usually provides them the best fodder for an acquittal.
And, to anyone saying that he(Ozzy) should have refused the search , that might have worked pre-Patriot act. However, the Constitutional guarantees regarding searches, seizures and invasions of privacy was swept out the window approximately 5 years and 11 months ago regardless of skin color. |
