Due to the nature of this post, it is pertinent that you know i am a female...
July 27, I got rear-ended by a big Isuzu Cargo truck on my way to Santa Barbara on the 101 freeway...i have a lil older 4Runner-that he hit- bumper & high up into my tailgate. SO he starts to pull away, but i got out and said "you're not leaving are you??" of which he responds "no, i'm pulling over to the shoulder" but that was dumb b/c we're in the left lane & cars are flying by - and that is 3 lanes there...so i said, write your infomation and it'll take 2 minutes and we'll be on our way. He does- then i write his license plate number. He's real nice. SO then i call- number outta service! It takes me 5 days to track down the Company name on the internet- and i call them, no Mike works for them! SO after giving his physical description, and the license plate number- the company figures out it's Dave and it one of their drivers at another branch. Santa Barbara is 2 hours (non-LA traffic time) up the coast from me at the LA coast..so i am going to SB again tomorrow for the weekend to 'deal' with this situation (b/c the company branch is way up towards SB). I didn't report to my ins co. b/c this shouldn't be on my driving record. I'd like solid advice from 2p2 on how i handle this situation. I could go to the cops too b/c of fraudulent infomation but i don't want Dave coming after me. Please advise... |

Aside from the typical, this thread is useless without pics, you should call the police, not the 911# but the regular # and ask them how to proceed from here. What was the response Dave's company gave you? Threaten to take them to small claims court, as well as taking Dave to criminal court for providing false information. Be honest with your insurance company, chances are they'll take over things from here, especially due that you were hit from behind. Make some calls, first to the appropriate athorities, then to your insurance company. Hit and runs (same thing if false info is given) plus damages don't bode well for companies, chances are they'll be willing to settle without too much trouble.

For the future , when ever some one in a "company" car hits you . You need to call the cops in |

You hav etwo choices:
1) Deal with it yourself. Be prepared to be intimidated, cajoled and abused by the company. You will need to threaten them with going to the cops, etc. One thing you can do is call their insurance and see if they will settle it. Since you aren't dealing with normal channels, they can make it miserable for you to deal with them. Also, just get susser to accompany you to the place. That way you can run while they are kicking his ass. I got rear-ended by a young attorney driving a client's car. The law firm cut me a check 10 days later after I got my car fixed. They also paid for a nice rental car. 2) Let your insurance company handle. It's what you paid them for. If your record is clean, I doubt the 1st incident affects your rates (don't know have CA works). If you already have a bunch of 'incidents' on your insurance then see #1 above. |
