This is a pretty textbook RICO case, and it seems to me that if the facts are reported correctly, they deserve to get hit by the full brunt of it. Its pretty clear that these defendants were involved with sportsbetting and thats a good legal basis for charges.
Falsifying credit card statements to facilitate LEGAL transactions is a crime, but a pretty minor one; doing the same to facilitate an ILLEGAL transaction is the big crime. So far, the DOJ has chosen not to take poker on directly. This is SOP procedure for them, they take the easiest cases first and see if that gets them what they want (anything with sportsbetting is an easy win for them). They avoid questionable cases when possible, and poker alone is a questionable case (go to the legislation forum for more on that). But they also dont stop. Once they have made all the easy cases, if some funding scheme for online poker alone is left, thats when they will come after it. This particular case seems a small step in the progression, but that progression inevetiably leads to us. Its only a matter of time. Skallagrim |
