Dan Druff, your request of extra compensation doesn't make a whole lot of sense. If I robbed some lady on the street and I was caught, should I have to pay her in excess of the money I stole? No. I go to jail or whatever punishment is given by a court. The same applies here. I know nothing of the Costa Rican law system or if these guys can be prosecuted at all by who ever, but something like that is the correct punishment here.
Furthermore, it could very well be that AP did not have malicious intentions, so they having to pay would be similar to a cop having to pay the lady I robbed in the street as he happened to walk by. Also, you require to see an explanation from AP about why they lied. Not going to happen, for very obvious reasons. Do you think they are going to say: "well, we thought we could get away with at first", "then, after all the investigation we really had no choice but to tell the truth to you guys". That's business suicide. |

[/ QUOTE ] Actually, at least in America, people who commit intentional torts are liable not only for compensatory damages, but for punitive damages as well. So yes, if you rob that lady in the street, she can sue you for more than just how much you stole, and she'll almost certainly win. (The only reason why this doesn't happen that often is that people who are generally robbing old ladies in the street are not the kind of people who pay their civil judgments or have the money to pay excessive civil judgments). Edit: We also have punitive damages in most states where you can show gross negligence, instead of just normal negligence. In this case, you can certainly show gross negligence on the part of Absolute. It's not just that they didn't act as a reasonably prudent Casino, they didn't act even close to that, and turned a deliberate blind eye to the cheating for over a month. |

First it was coming Friday, then Saturday, now Sunday. I want to remind AP, that if we have to wait another day, you have to give up another frat boy. In the time we have been waiting however, AP has gotten their lies and BS into mainstream media stories on the scandal. |

There is still NO real evidence, just accusations against AP. If you think public forum postings are evidence, your intelligence is definitely in question, at least as far as I am concerned. |

One more thing: AP has already given/promised everyone in the Potripper tourney file $500 for disclosing their personal info. That's non traditional compensation. Surely there is other compensation beyond money lost at cash games that people are still owed here. If Potripper knocked me out of the 1K he won I'd be screaming for my buyin back. I might be even if he didn't. This is going to show the inadequacy of the standard "bump everyone up one slot" way that these things are often resolved. You will still have people who were obviously cheated that don't get proper compensation under that structure. That also suggests that some theoretical/non-obvious extra compensation needs to be considered every step of the way to make people whole. If people are saying "hey wait one step at a time... let's get your losses recovered first" that's one thing. But dismissing alternative compensation methods outright is another. Absolute Poker may not deserve to burn for this episode- (jury is still out on that) but the hit to their pockets is at least partly their own doing here, and I don't understand taking any position less than that. |
