Do you have GPS on your boat? It seems to me that if I had a boat I'd get lost a lot without it.

I initially read this as "My goat got stolen". Very disappointed. Sorry about the boat, though, man.

Did you sign any waiver saying the repair shop wasn't responsible for theft/destruction/etc. while being repaired there? If not, you should get at least reimbursed for the FMV of the boat itself since it was stolen while in their care. Either go after them via a lawsuit (which might cost you more in legal fees to be worth it) or insurance should pay for it. [/ QUOTE ] Those waivers are usually BS even if you do sign them. |

[/ QUOTE ] Really? Why is that? I imagine by calling them BS you mean you really do still have recourse if the business screws up. [/ QUOTE ] Yes, you are correct. In many cases, businesses try to avoid negligence lawsuits by saying that the waiver was signed and depending on the case a judge can rule that either the waiver is not in compliance with the law or that it doesn't apply in this particular case. This is especially true in negligence cases against ski areas where by purchasing a lift ticket you are "signing" to the terms on the back of the ticket that are not presented prior to your acceptance of said ticket. |

[/ QUOTE ] Yeah generally gross negligence doesn't hold up against those waivers. Also the courts won't really let you sign away basic rights or let businesses take advantage of you by giving you a ridiculous waiver to sign. I'm not a lawyer or anything and I'm sure a real one can clarify with more precise language. The most common/basic example is that even though the drive-thru car wash says "Not Responsible For Damaged Vehicles" if that thing rips off your sideview the car wash people are responsible. |

[/ QUOTE ] A repair shop can't have you waive their liability for your property when it's turned over to their custody. Standard commercial insurance has a section called inland marine insurance which covers damages or loss of a "customers' property in a bailee's custody". A bailee is anyone who takes possession of your property to work on it, like an auto shop, dry cleaners etc. |
