Re: Nifong May Get Jail Time
[ QUOTE ]
And a judge has since ruled his sentence as absurd, but the prosecutor is STILL trying to keep him behind bars! [/ QUOTE ] To be fair the judge was acting outside the lines of his authority. Neither of the two parties in question make the laws. The prosecutor should never be able to cherry pick the laws he wants to enforce, and judges should not be able to let offenders go free because they don't agree with the law. If the people actually cared the jury should have nullified. |

I'm not sure what this means? In any event, this is a clear injustice looking for common sense to prevail. The young man would've gotten a lesser sentence had he had intercourse with the woman, instead. I realize all states have antiquated laws on their books. But they should correct this injustice immediately and then fix the law ASAP. Don't you think? |

judges should not be able to let offenders go free because they don't agree with the law. [/ QUOTE ] What if the "offender" is a slave and his offense is running away? [ QUOTE ] If the people actually cared the jury should have nullified. [/ QUOTE ] Assuming they knew about nullification. |

Assuming they knew about nullification. [/ QUOTE ] A jury shouldn't have to know what "nullification" is in order for nullification to work. In a really egregious case it should just happen naturally. |
