Getting out of a ticket on a technicality
Recieved a ticket last Friday (3/30/07), one that I would like to contest. The officer said I can pay it or show up to my court date. After closer inspection I noticed the court date was 2/26/07, over a month ago.
I've heard of people getting out of tickets based on the cop misspelling someone's name, but not sure if that holds any ground. The fact that the court date is wrong doesn't change the legality of my actions. I'm really looking for a cheap way to get out of a ticket, as I've never had anything on my record prior. Right now my play is going to be to call the station and notify them of what the situation is. I assume they will simply reschedule my date. Thoughts? |

You're more likely to get out of the ticket by changing the date and then showing up to court (since the cop likely won't show), than based on this technicality alone.
Even if the cop does show, if you just say that you honestly don't believe that your were speeding/whatever the judge will probably cut you some deal anyways. BTW, stop breaking the law. |

I'm 1 for 2 with them (with 1 currently pending). But I do know of 3 other people who've used the described process and successfully challenged the ticket. |

Ticket was for going down a one-way street the wrong direction. I was dropping my girlfriend off, and her driveway is 20 feet east of Dodge St on Iowa Ave. So I decided to be lazy and just sneak up the empty one-way coming from the west. Apparently not sneaky enough.

That was stupid. [/ QUOTE ] And you have no chance of beating it. The ticket payment date is usually before the court date (not considering the date error) which gives the DA notice that he has to have the cop present in court. Just pay your stupidity fee. |

I usually just request discovery, and if it doesn't' get sent I can just get the ticket dismissed. If they do send discovery then I hire a traffic lawyer to get me out on some other technicality. Most tickets are easy to get out of but people are just too lazy to bother. |

This happened to me late Thursday night last week. Cop asked me if I was retarded, gave me an alcohol test then told me to challenge it in court because I will most likely win.
