But even if he didn't - he's not using their images/videos to make a profit. I remember hearing once that if you're on the street, you're essentially public domain. Can any lawyers confirm/deny that?

You really assumed he got permission because they smiled when they saw a camera tracking them? That seems like quite a stretch.
