“Under EEOC’s guidelines, an English-only rule violates the law unless the employer can provide a legitimate business justification for forcing employees to stop speaking their native language,”ť said Estela Díz, trial attorney for the EEOC’s New York District Office. “The Salvation Army presented no such justification.”ť
Requiring employees to speak English where no business necessity exists constitutes national origin discrimination under Title VII of the Civil Rights Act of 1964. The EEOC filed suit after first attempting to reach a voluntary settlement. |

It's a bit hard to argue that "no business necessity exists" though, because being able to communicate, in general, is a business necessity.

The two employees, who were clothes sorters, had been working at the Salvation Army for about five years before the Salvation Army decided to enforce their English language rule. One would think the Salvation Army would have a hard time proving that they weren't able to communicate with them if they had already been kept on for five years.

and the pundits wonder why american public is mad about illegal immigration when everyday people are explicitly told they need to be bilingual (speak spanish) in order to get a good job, keep a good job, move up the ladder, etc.
