Default Player wins with a mucked card...

Okay, um, so I saw this dealer this morning do this. It was a mid-stakes game, running fast and furious, not a full table, and the player in Seat 8 mucked his cards while the dealer was briefly distracted. Dealer's head is turned, and 8's cards are touching 10's, but in a way where it seems obvious which are which, based on position of cards.

Dealer separates two and pushes the other two to 10, who hadn't even touched them yet. 10 raises in LP, a bunch of folds and a call, sort of during which 8 is timidly saying, "one of those cards was mine..." It's HU, some betting, 8 still mumbling a bit here and there. The hand ends on the turn, 10 shows a set of aces, 8 says he had an ace, 10 says it doesn't matter it would have played the same anyway.

So, um, thoughts? And yeah, okay, this dealer was me, I made a snap judgment, I f'd up, so, oops.

Is this an error that affects play? If you're the floor and are called over after the raise and subsequent action preflop, what happens?

Oops, my bad, this is hold'em (hint: no seat 10 in stud). Player 8's mucked cards were intermingled with 10's, but 10 played anyway with what was most likely one of 8's cards.

Oops, my bad, this is hold'em (hint: no seat 10 in stud). Player 8's mucked cards were intermingled with 10's, but 10 played anyway with what was most likely one of 8's cards.

I would HOPE that the correctly ruling is that seat 10's hand is dead, and the money in the pot is returned to those who put in bets. This would make sense...

No, it would make no sense to let Seat 10 put in bet after bet, with a hand that can't win.

If you want to kill that hand, do it before he plays three rounds of a hand. Once all that action was offered and accepted, there's no going back.

Then the dealer gets written up.

You should have mucked seat 10's hand with seat 8's.
"Sorry seat 10 you didn't protect your hand."

Then seat 8 said the cards were wrong.
You should have called the floor right then.

Or it could be the cards weren't mixed up and seat 8 either was mistaken about that being one of his cards or he said that to cause problems at the table.

OP said the cards were intermingled.
