Dog Poo Neighborhood Feud (with MS Paint)
I have a situation brewing in my neighborhood and I wanted to get OOT’s opinion.
Background: I have some neighbors who live across the street from me in a green house. Their backyard is fenced in as they have a couple of kids and a dog. This fence was built a few years ago. The fence is about 8 inches short of the lot line and is entirely on the green house’s property. The blue house is occupied by a family of 4; a husband, wife and 2 very active boys aged 8 and 7. The boys spend a lot of time outside playing soccer amongst other things. Here is the deal: The green house keeps their dog in the backyard (fenced in area) when it is outside. I’ve never seen the dog outside of the fenced area. As a result, the dog defecates in the only place it has access to: the backyard. No problem so far, but here is the thing: when the owners of the green house clean up the dog poo, they dump it over the fence on the side facing the blue house. They don’t throw it or anything; they just reach up over the fence and dump it. The majority of the poo lands on the 8 inches or so of property owned by the green house. The result is a long narrow mound of dog poo that lines the fence facing the blue house. The owners of the blue house have approached the owners of the green house about the inconvenience growing piles of poo along their lot line. Every time they drive up their driveway, there it is. The boys have gotten into it while playing. The inadvertently kick there soccer ball into it, etc. The owners of the green house basically said “Go f*** yourself, it is on my property.” So OOT, what should the blue neighbor do? I am not aware of any legal ramifications. Should they concoct some diabolical revenge? What would you do? [image][/image] |

*** this post does not contain legal advice ***
Not much Blue House can do other than build a 12-foot fence on the lot line. Then the poo zone would be restricted to that 8-inch wide space, and kids & toys wouldn't get into it. |

This can't be legal, it's a health hazard. Call city hall and ask what can be done, I bet they help you. You probably have to call some housing board or something and get someone with authority to threaten to condem their property for being a public health hazard.
