Default 5 Kings in the Deck

In a NL game at the Borgata, I was at a table where there was a foul deck. A hand occurred where there were two players to the flop. A king came on the flop and after some betting one player folded his hand and the other player showed pocket kings and raked in the pot.

After the hand was over the player that folded claimed he had ace-king. I called BS because I folded a king preflop, but he claimed he had AK and asked the dealer to check the deck. After checking the deck, it was determined there were in fact 5 kings in the deck.

Now the individual that folded AK did not ask for his money back even though the deck was foul. My question is whether he would have been able to get his cash back since the deck was foul? If the answer is yes, would the money come from the player that won the hand or from the casino since the deck was incorrect?

I believe the general rule is that the hand is void and everybody that put money into the pot gets it back. Seems like everything was done soon enough that that should have happened.

Do they vacuum the drop out of the drop box as well?

Doesn't the Borgata use all auto shufflers now? The deck would have to be short another card for a 5th king to slip in without screwing up the count.

Also, in every event of a fouled deck I've seen the House has returned the drop to the players. Unless you can directly connect the error to someone other than the dealer, the returned rake comes straight from the dealer's pocket.

Don't most places put the drop in the tray? The Borgata does, its not hard to pick the chips up and give them back.

In California, its is procedure for each dealer to carry their own tray to each table they deal at. Tips are placed in the dealer tray.

This incident occurred 2 years ago, so there were not any automatic shufflers at the table. I was just reminded of it today so I decided to post about it to see what should have happened.

All the floor did was change the deck and no one was given their rake back. My question is if people in the hand were suppose to get their money back, how can the casino force the person who won the pot to give it back? It was not his fault the deck was foul and the pot had already been pushed to him. The chips won from the hand were in his stack when the discovery was made. If anything, I think the Borgata should have given the player who lost the hand his money back, but I was not in the hand so I decided not to interfere.

Pretty common in AC. I suspect they all do, but only know the Borgata and Taj for sure.
