As an intellectual exercise, talking about poker skill v. business skills and all the rest is a lot of fun. But as I posted elsewhere:

SKILL V. CHANCE IS THE LEGAL TEST IMPOSED ON US BY COURTS AND STATUTES IN ABOUT 37 OF THE US STATES. A big part of our effort is getting these laws changed somehow, another big part of our effort is or should be showing that we can meet this test and beat it.

Its never been that I have been in favor of making the skill v. chance argument - actually I wish it were irrelevant and personal freedom were the only issue. But that just aint the way it is in our wonderful democracy, at least not right now.
