I will contact a solicitor very soon, most likely, but am interested if anyone here has experienced this and what the outcome was.
Or if anyone knows anything about what the insurers are liable for?

If I were an insurer or owned a road (see my location) I would have zero tolerance for drunk drivers. It's just so dumb. Not sure why this is politics, I propose Iron move it to OOT so op can get NT'd
