Close, but not quite there. (Although there is the issue of poker coverage itself in the same facts.)

The UIGEA does apply to intertribal gaming, unless that intertribal gaming is "authorized by the Indian Gaming Regulatory Act".

Also, if, as I noted, the action crosses State lines, then I doubt it is so authorized.

Either way, as a tribal matter or a poker coverage matter, a good test case.

I would assume that if you and I know they need to follow intertribal gaming rules, they caught that also and are compliant but you could be right.
