That's was the point of my post. Why should any business be allowed to "have you at their mercy." Would you give your business to a store who decided to take your payment for a shirt but then the manager came out and said that because you tried on too many shirts you wouldn't be allowed to take it but they would keep your money? And you had no recourse? What if every store had this policy so there was no other place you could shop? And what if on some shifts the managers didn't care and let you try on as many shirts as you wanted so that you never knew when your money would be confiscated?
