City councils have already acted to restrict activity that endangers health -- smoking in buildings, cell phones while driving, etc. So long as these decisions are at the local level, it's not so much an issue -- people have far greater ability to influence local politics, hold those accountable, or move to another town (and even retain the same job). If a homeowner's association banned aluminum bats at its park, I doubt nate's outcry would be similar.
