If you have a solid read that this particular villain only checkraises with a set or better in this situation, then yes, fine, you can fold. This is a very unusual and difficult read to be certain of, though.

Most villains can checkraise with a fairly wide range here. You're just making the usual cbet you always make, so villain probably assumes you just have whiffed overcards. The SB could have any number or draws, so this villain has good reason to think top pair is the nuts here.
