It's possible this isn't true. Roberts' big thing is trying to build consensus (and avoid 5-4 decisions) by making rulings as narrow as possible to decide a case. Whether or not the law is unconstitutional isn't necessary to decide the case if the ads weren't even covered by the statute. I haven't read the case, so I'm just speculating, but it's possible that if an unambiguous case came up Roberts and Alito might find the statute unconstitutional.
