Sorry, but if a player has to cap his cards or pull them back when they are in the bb and obviously not intending to fold (especially before its his turn to act) then there is either something wrong with the dealer or the rule itself. That rule is mainly in place to protect the 1 and 9 seats where it is much harder to tell that a hand has been mucked. Having to protect your hand from idiotic dealers shouldnt be an issue in any respectable room, which is why the Wynn paid him back his money.
