You may be right about it likely going to no action, but I think that would only be because the legal processes take too long. From what I understand after hearing some legal experts discuss this on TV is that there is almost no way that Anna Nicole can get out of this. The courts will eventually force her to be tested as Birkhead has the right to know if it's his kid.
I agree with you that Birkhead seems very likely to be the father. After evaluating all the elements of this story, my guess is more like 95% chance he's the father.
