The judge explictly distinguishes the lucky lottery winners (flawed system or not) from those with inside information (race horse owners), and those with skill or predatory systems (seasoned card players and pool players).
It's ironic. CRA loses another case against gamblers and the judge puts another nail in the coffin for the professional card player.
But people don't want the truth. They'll just point to this case and argue that playing poker professionally is not taxable because it's gambling. Eventhough the judgement reads: beating the odds is not taxable and seasoned card and pool players are not of the same category.
