Driving Accident Question

I'm driving on a one way street with 2 lanes of traffic. However, the lanes aren’t marked with a dividing line… it’s just wide enough that two lanes of traffic form. There is a bus stopped at a light in right lane. As soon as the light turned green, I tried driving past the bus on left, but the bus starts to move a little into my lane and swipes me.

1. Is it legal for me to try to drive pass the bus?
2. If it is legal, would it be my fault?

Re: Driving Accident Question

if it's a city bus you can pass all you want, if it's a school bus then you can only pass when the lights aren't flashing and the little stop sign on the side is folded in. Driver's Ed 101
