Former Employer will not give me my W-2...What now?
 
Cliff notes: Former employer will not send me my W-2 and keeps dodging my phone calls. What is my first course of action? I can give more details if needed. Just thought maybe someone has some experience in this area. I have emailed the IRS , no response as of yet. Thanks.

Assuming "former" employer. Write the IRS and cc the employer. Keep asking till April 1st. Then fill 1040 based on last pay stub and explain to IRS the situation. Don't be nasty but be firm with employer. If the employee is having financial problems, then the IRS already knows. Don't be a jerk, desperate people do stupid things so keep your distance. Pay stub is OK for IRS under the circumstances, a description of your attempts, in the return, is fine. Your refund might be late, but you'll get it.

If you have no received a W-2 from your employer by February 14th, you need to CALL the IRS. It's much more effective than EMail (and it's what they tell you to do in this situation). 800-829-1040.
