DID HE MUCK?!
 
Ok. 1/2 Live game.

On the flop I am all-in with an open ended str8 draw vs. a villian.

The villian calls my all-in and flips up his cards revealing a set.

I do not show my cards UNTIL the TURN when my str8 hits.

When I flip up my cards the villian (who is pissed as hell) throws both his cards at the dealer. One lands face up infront of Villain the other lands on the railing also face up. Both cards hit the dealer.

The river pairs the board. Dealer pushes the pot toward villian.

1) Did he muck?
2) Should I say he mucked and the pot is mine?
3) What if one or both cards landed face down?

Villain should be shown the door for throwing cards at the dealer, but it's a tabled hand.

from your description, it sounds like neither of his cards hit the muck.

There was no bet(and none coming since it was all in) to him when he mucked so he qualifies under the cardspeak rule.

Doesn't matter. Cardspeak was attached when he tabled his hand after the all in action. Even if both cards hit the muck face down.

The betting on the hand is complete and he has turned his hand face up, making it clearly identifiable. I really hope you didn't try to argue he shouldn't get the money here.

If he, for example, had released his hand as described facing your bet, then he has folded and you win. If after seeing your hand, he discards his hand face down, the dealer should sweep his hand into the muck and award you the pot. He has (in a d-bag manner) revealed his cards at showdown, and they are face up and must be identified. He wins.

No, he didn't muck. He called and his cards were turned over. But was he pissed when the straight hit, or was he pissed before that becuase you slow rolled him? As soon as he called your all-in you should have turned your cards over for him to see. I know that'd piss me off.
