For those who don't want to go to the link; the claim here is that Mike Vick (aka Ron Mexico) getting caught for smoking pot can get his prison sentence lowered and let him spend some of his prison time in a half-way house (half-way house where a bunch of stoners live together and support eachother's ability not to get blazed, SUPER LOLZ!). From what I've read so far, this loophole only works if you get a 30+ month sentence, so it is doubtful he will qualify for it.

But it does seem to reward drug users for their behavior instead of penalizing them.

I've never done drugs, but if I'm ever in a position of being sentenced for that long in jail, I might start taking them so that I can cut a year off my sentence.

It's not outside the realm of possibility that the heavy handed sentencing judge could have forgone the prosecutions recommendation and given him the max 5 year stint.

If this loophole holds water, that's off the table, and the effective max theoretical term is less than it was before.

It may not factor in at all, and it may increase an otherwise potential lenient sentence....but if nothing else, it appears to be a solid hedge against the theoretical maximum.

No. Penalizing drug use itself is stupid.
Penalizing non-drug crimes but giving offenders lighter sentences because they use drugs is completely different and really stupid.

i'm guessing the spirit of the rule was to get people punished for drug use out of jail. people punished for other stuff taking advantage of this is bad, but i agree it is a step in the right direction
