SCOTUS Decision: Garcetti v. Ceballos
Good blog discussion of this case
Anybody else following this case? IMO a terrible and somewhat scary decision by the majority. Ceballos worked for a prosecutors office and wrote an internal memo suggesting a possibility of illegal behavior in obtaining a search warrant. Ceballos was then re-assigned to a less desirable position apparently in retaliation for the memo. Ceballos claimed his First and Fourteenth Amendment rights were violated. The Supreme Court ruled that speech relating to a gov't employee's job is not protected. The only way it could possibly be protected is if Ceballos wrote a letter to the editor or maybe posted on a personal blog about his opinions. As far as I can tell the decision does everything to promote gov't corruption and nothing much to promote transparent gov't. |

That's the beauty of the Supreme Court. They don't decide on what would have the best results. They rule based on what the law says.

At least read the syllabus to the case before posting moronic generalizations. The majority opinion clearly made a ruling they believed would lead to the "best results". |

Alito is a stooge for big brother and big govt. No question about it. His decisions have been terrible so far an dthis one is no exception. I don't see it getting any better down the road.
