Yes, although our system is certainly not 100% accurate, thus we have to ask if we're accurate or not. It's kind of like porn sites asking if you're 18 or not.

Yeah. I got a notice that they detected that I was from Wisconsin via my IP address and I had the option of confirming or denying that fact. If I were to confirm it, I wouldn't be able to view BW. I lied and denyed and was able to get in.

We aren't banning anybody. We are checking IPs of people who view the site, and if we detect they're from a state where online poker is illegal, we ask them if our IP checking is accurate.

There have been casino affiliates arrested in FL. I also heard of an affiliate in WA that got a cease and desist letter from some DA. I don't think it's unreasonable for BW to take some precaution.

I've been getting that for over a year now, but you are right its getting to the extreme now, and no not just because of this gambling bill (there were other unbelievable bills that were also passed that week).

I've been getting that feeling for over 20 years now, and that's only because I'm not old enough to have gotten the feeling for the last 150. Just as one example, the War On some Drugs has been far worse than anything passed this year.

Referring to the affiliate sites being constitutionally protected not pipe bombs. My point was these states have laws against poker sites and affiliates and anyone in general who links to poker rooms. Its constitiutionally protected to TALK about illegal activities, not to link to where to buy them.

"Join FNFRISTPOKER DOT COM and use sign up code 'mysitename' for a $X bonus, sorry but you have to type it... links are banned."

and still get affiliate credit without having a "link"??

It's perfectly legal for Americans to be affiliates of poker sites. The prosecutor would have to prove you are specifically targeting Americans with your advertising. The internet is global, it's legal to put up a site and make money sending Europeans or Canadians to poker sites. And since your innocent until proven guilty they would have to prove your intent was to promote illegal gambling in the US.

The only affiliates ever prosecuted did stuff like put flyers on car windshields or some other crap offline.

If I'm wrong tell me cause I'd like to cover my own ass, but I'm pretty sure I'm safe.

Seriously. I'd really like to see it, and as a lawyer I have some ability to discern whether it is constitutional.

Im telling you its not perfectly legal, in WA state for example it is a C class felony and at least one site has gotten shut down that resided in WA. Now of course they cant shut down an out of state site but as early June it has been illegal in WA. Constitutionally you could give an argument I suppose(I dont remember the right to affiliate with gambling venues as a constitutional right but w/e) but it is explicitly illegal in WA and FWIU the other states listed as well.

It is not against the law to talk about illegal activity. It against the law to promote it. Affiliates are not merely talking about illegal activities so BW's response is perfectly reasonable seeing as they are the ones potentially put in legal jeapordy.

You pipe bomb analogy found all those sites that discuss pipe bombs, but if there was a USA site promoting pipe bomb construction and making a profit off that promotion, it would not last very long.

BW has sign up links to all the sites listed there. Therefore, they are "aiding and abetting" the poker sites in acquiring customers.
