Will the courts allow the parties to clarify or substitute consideration if the original consideration is vague or unperformable? And can the parties do that after one party has fully performed?

Yes, that would be a novation.

Re: Gold responds in some detail to allegations

Looks like we wait a while to hear the resolution of this matter. Both parties stipulated to postpone the hearing until December 21. This pushes the deadline for Leyser to respond to the motion to December 15th.

The reason they cited for pushing it back was to allow the deposition of both parties to take place first. This makes some sense from a legal perspective, since it will provide a lot more facts and will lock both sides into a more clear position. It will also make for more interesting reading for us, because Leyser will almost certainly quote stuff from Gold's deposition in his response. Gold's deposition is set for Nov 30 and Leyser's for December 1.

This last bit is pure personal speculation: Reading between the lines, it might also imply that there is some hope for settlement talks. Gold would presumably prefer to avoid another round of publicity that will almost certainly follow a ruling on the motion.

I played with Jamie on bodog about 2 days ago, multiple sessions. He didn't say much though, just referred to his website, and said its still up in the air.

Also some guy was like begging him to let Gold be his agent. It was wicked funny, Gold was like "Talk to me in a couple months man"

if Leyser didnt do anything, like put up money for Jamie to play,I don't see how it could be considered a deal at all.

I dont think Leyser has a case even with the phone call.

It isnt much different then putting someone in a will and then taking them out.
