So im sitting on pocket 2s. Board is 345 rainbow.
Tight player leads out, i call. River comes the Ace. Tight player raises 30 ish, i push, he calls.

River is the 2, completing a straight on the board. He throw his hands in the air in dissapointment. I throw over pocket 2s and say "I had the straight on the turn mate, sorry, you got a set of 4s or 5s?"

Withtout even realising the board makes the straight, he mucks his hand. Dealer starts to collect the pot. Then someone notices it should be a split and yells out.

Dealer says too late, and supervisor behind him sorry, too late, ship the pot to me.

Now, i know im fully entitled to the pot as the player mad the mistake. And i realise that i didnt do anything wrong by not giving him his money back.

However being big stack, obvisouylni got the comments from the other players that i should of "giving his money back".
I said "well i know none of you would of given me my money back if that happened, then im not gonna do it either".

Obv from that point on i was seen as the biggest [censored] on the table.

Would anyone have given the money back, or atleast half of the players loss? Keep in mind the other guy didnt even flip his cards over before mucking, he just mucked, and nodded his head when i asked if he had a set.

Cards speak, but had no cards to speak for him. However, can't he say he's playing the board? Do you need your cards to do that? (Haven't gone to a poker room yet.. 21st birthday in a month [img]/images/graemlins/laugh.gif[/img] )

Well... Karma and the Poker Gods aside, he cannot say that he is playing the board.

Once he mucked his hand, the hand is dead, period. He could do anything else - Even if he tabled his hand and threw it in the muck, technically as long as he exposed his cards, in most casinos - the cards speak. Using that logic, I could fold pre-flop and go "crap, I would have made the nuts" and get part of the pot.

Personally, I would not give him his money back. You are well within your rights to keep it, the casino would support your choice, and let the nits at the table curse you for the good luck.

Think of it like a +EV thing. Much like a drunk donking off his stack to you, this is a gift at the table. He's a fish, and the Poker Gods smiled on you giving you an extra bit of money.

Did you do this deliberately to get hi to throw it away? With a straight on the board (and you not having a higher straight) this statement is perilously close to an angle. If you said this to him in confusion, implying you had a set beat, I'd say there was a strong moral case for giving him his money back. And if you did this deliberately, it's a pretty scummy angle.

Technically, of course, you are entitled to keep it as everyone else said.

Happened at my local casino, no i did not return money but did by drinks for him the rest of the night ($1 tip not full price) Seemed to make him happier

This guy should know to look you up on your straight, especially if he called your push. I for one can't see someone calling a push and then not seeing my opponents hand inspite of the board straight.

If he can't read a board, and wants to call an all in and then open fold to someone saying "Straight," he only asks to lose in the long run.

What a Ding-a-ling.

He should consider this a good lesson. He got his money's worth.

The only dick move is if you cheesed it the very next hand. Then I commend you.

This is the difference between cash and tournament games with the all-in rule - see the JC Tran controversy a few weeks ago. In a tourney both hands would be turned up, whereas in a cash game players can still muck their hands. You're within your rights to keep the money, and buying him drinks is a good move imo.

He can SAY he is playing the board all he wants, but unless he tables his cards face-up he is not entitled to any portion of the pot.
Its a standard rule, you must show both cards to contend for the pot or portion thereof.

Technically by Robert's you can say you're playing the board and muck, but I would not advise anybody anywhere to do that ever. Your local rules and floorpeople may and most likely do vary.
