turns out sklansky is moonlighting as a female municipal judge in philadelphia

Re: I\'m on to you sklansky

Oh whoa. She agrees over the internet to have sex with this dude and his friend for money. But then several men arrive, gang bang her unprotected at gun point, don’t pay her, and the judge says, “ it’s an occupational hazard.” She was not raped, but her property ( services )was stolen. Interesting.

Re: I\'m on to you sklansky

I found this post quite interesting. Does no one wish to talk about it? At the very least, using this judge's logic, these fellows should also be charged with attempted murder, because they had sex with her ( forcibly ) without protection. Even if they all tested negative for HIV, gonorrhea, syphilis, etc., they inflicted unnecessary suffering on her by making her wonder if she were inflicted with one of these diseases or if she were pregnant. So in addition to armed robbery, certainly, some additional crime was committed against this woman, regardless of if she were a whore. If a thief broke into my property, held me at gun point, robbed me, then released a gas bomb, that caused my body incalculable damage, then the release of that gas bomb should certainly be a further serious crime committed against me, over and above armed robbery. Or perhaps the judge is correct in the criminal aspect of the case, and the woman should sue the culprits civilly for further damage.

This is stupid. How come she doesn't get to say no to the other guys after she's said yes to the first one?

It's probably just the judge's moral standard against prostitution.

Then again, I want to add that rape is way overrated. I mean, most people would much rather get shot (provided they survive) than getting raped, this is a ridiculous social pressure that we need to get rid off. So you got raped. Besides the chance that you got a STD, it's no big deal. It's stupid that we force people to believe getting raped is worse than having someone beat you to unconsciousness.

There has never been much sympathy in the legal system for raped prostitutes.

Why do you say that we force people to think that? Who says the trauma isn't a genetically ingrained reaction in women?

oh please what? you don't believe in evolution, or you fail to see how that could be developed through natural selection?

Here are my thoughts. In order to birth fit offspring, a woman has to be very selective with who they have sex with. This means that they have to be extremely protective of themselves. Having a terrible and seemingly disproportionately large emotional reaction to being raped seems a likely byproduct of that.

Re: I\'m on to you sklansky

There exists cultures (tribal ones mostly) where rape isn't a 'big deal' when done by opposing tribes in times of war in terms of emotional trauma.

But anyway it is a moot point, cultural or genetic - the inflicted trauma is real. Imagine if you are a man and get raped - for most men that would have an extremely negative impact on their life.

Depends. Man or woman doing the raping? Serious question.

Because as a man, being raped by another man would seem to be much worse physically than being beaten up. But this is not exactly the case for a woman being raped. Not that it is pleasurable by any definition, but it is at least kinda natural.

By your reasoning it should be worse for a woman to be forcibly eaten out by another woman than forcibly penetrated by a man. I doubt this is the case.

I was talking about man on man rape and I consider it worse, not becauase it's 'less natural', but because it involves penetration. Also, sex is an expression of power for males. It isn't for females. So when a male rapes you there is that psychological component to it.

Except that we don't see this kind of behaviour in other animals. Most female animals don't like being raped, but they don't make such a big fuzz about it after it's done.

In fact we don't even see this behaviour towards rape in all of human culture...

Hell, just go back a couple centuries in human history (or better yet, millenia), and you'll see quite a different picture.

[/ QUOTE ]

I'm pretty shocked by the judge's ruling. Where did theft of services come in. This is an illegal service. Only Vegas has legalized prostitution. So how do you prosecute for nonpayment of an illegal service.

However there was an assault possibly aggravated because when you threaten someone with bodily harm with a weapon that's the real crime.

You could probably break this down to aggravated assault by the first 2 people and aggravated assault/rape with the second 2 people. She didn't consent to sex with the second 2 they just showed up while she was under fear for her life. It would all depend on the state's legal definition of assault, but its common for states to define a threat as an assault, a weapon can make it aggravated, bodily contact is what makes it assault and battery.

Basically, the judge's ruling is crazy and probably morally biased. Possibly the lady's attorneys didn't make the right charges and correct argument on the charges. I'd like to see how the judge reacted to someone holding a gun on her in any situation. She might develop a whole new perspective on life.

Most people have no idea what they're talking about wrt rape. And it's hard to find reliable information. Rape is a sensitive subject about which many people have strong beliefs. It's hard to discuss rationally.

Which is why the law must respond to rape in a consistent and objective way. This judge should lose her job at minimum.

I can't totally disagree with this. Of course, rape is terrible and can be life ruining for some. What he's saying, I think, is there's no reason why it has to be. And that if we get rid of some of the cultural stigmas surrounding sex, it could be experienced as less horrific in the future.

Re: I\'m on to you sklansky

After a friend I knew a few years ago in college was assaulted, I felt very strongly about the subject since I saw the impact it had on the person.

Then it was rightly pointed out to me that my judgment about the subject was very bias and it might not, on the whole, be as big of a thing as it was in my personal experience. I actually made a quite a study of it (for credit in my sociology class of course) with much research and I even had several interviews with women in various walks of life.

I don't know whether it is inherently biological or part of social programming, but the act of rape is often, though not in every case, one of the most violent psychological crimes that can be committed. In most women, it creates all kinds of horrible psychological problems, which vary widely (could be almost anything, from trust issues and confusion to complete personality changes or any random difference in how they think), although a good number are able to cope after some time. In women who work with sex, like hookers or even exotic dancers, the psych problems are much less varied and often associated with a loss of control over all aspects of their life--but it is commonly the case that the harm is just as severe.

The judge should be fired or disbarred or whatever immediately IMHO. She really has no idea what cases like that are like for the people involved and is letting her personal views on sex and prostitution disgrace the meaning of justice.

[ QUOTE ]
The prostitute, a 20-year-old single mother, [...] She met the defendant, Dominique Gindraw, 19, at what she thought was his house, but which turned out to be an abandoned property in North Philadelphia [...] When a fifth man arrived and was invited to join, DeSipio said, he asked why the girl was crying

Also, please feel free to print out this complaint form and sent it to

Judicial Conduct Board
Pennsylvania Place, Suite 403

Harrisburg, PA 17101

since they only accept complaints via snail mail. I know most of you won't, but for those of you who like me actually feel the need to do something when crap like this happens, it's something useful.

Alternatively, you can e-mail the chair of the Philadelphia Bar Association, Kenneth Shear, at [email protected] or call him at (215) 238-6338. You can try calling or writing the judge herself (linky) if you think it would help, but I usually find that the people themselves don't want to hear it.

This judge was completely wrong and needs to know it.
