Big home game robbed, player dead.
 
A high-stakes home game in New Smyrna Beach Florida was robbed at gunpoint, one of the players is dead. From the sound of it this might have been more than just the average home game of course... take a look at the guys driveway below for a chuckle (not that there is anything funy about someone being shot of course).

NEW SMYRNA BEACH, Fla. -- New Smyrna Beach police are desperately trying to find two masked men responsible for a fatal home invasion at a house known for gambling. Police said 62-year-old David Michael Turner was killed overnight when two masked men stormed into the house on Mill Run Drive and demanded money during a poker game.

Investigators are still trying to figure out if the man killed inside the home was targeted or if it was random. He doesn't live there; he's from Port Orange.

Some in this neighborhood don't think it was random. They say everyone knows the homeowner hosts card games several nights a week and the players bring a lot of cash.

Residents in a New Smyrna Beach neighborhood woke up Tuesday morning concerned about what happened inside a home in the 500-block of Mill Run Drive.

"This is a quiet neighborhood. Nothing ever happens around here. Just a tragedy," said neighbor John Kates.

Police said, around 9:30 Monday night, about eight people were playing poker at the home when two masked men stormed in and demanded their money. An argument started and the suspects fired several shots. One of them hit 62-year-old Dennis Michael Turner, who drove over from Port Orange to play poker.

Investigators don't know if the masked men were after Turner or the homeowner.

"I knew something was going to happen over there eventually," an unidentified neighbor said.

Neighbors said the homeowner is a frequent gambler and card player. He even has cards painted on his driveway. Neighbors said he normally had people over throughout the week for games and a few months ago he told them someone broke in and got away with a lot of money and valuables.

"They got him for $30,000, some guns and gold he had in the house, but he wasn't home at the time," Kates said.

Investigators said it's possible the homeowner could face charges, depending on how high the stakes were during Monday night's poker game.

"In Florida, you can have penny ante game up to $10 per hand and it's perfectly legal, so we're not sure how much they were gambling dollar-wise, but we're looking into that also," said Sgt. Michael Brouillette, New Smyrna Beach Police.

While investigators are looking into the gambling, they said their top priority is tracking down the two masked men.

This is why I politely decline invitations to home games - and settle for friendly games with close friends.

How could a game like this not be robbed eventually?

agreed. I used to go to a semi-home game, lots of fish, then it started attracting the wrong crowd. I stopped going. 3 months later (which was 2 weeks ago) it got robbed.
From all the posts on here, stories from friends, newspapers etc... Anybody that runs a game that is not just there close personal friends usually either gets robbed or busted.

Same. My buddy is always inviting me to large private tourneys (100+ entries) that some local poker club/group holds, and I always decline. The chances I will be robbed or just cheated are a hell of a lot higher than if I go play in a casino.

Thats not shocking. In NY State have 5 guys break into your home and hold you at gunpoint, you pull out your trusty pistole and fire away killing 2 and wounding the other three. The robbers and their next of kin can press charges against the home owner and its possible the homeowner will see jail time.

This is America. Anyone can sue or "press charges" against anyone else... I assume you are thinking of a specific case, but in general it is not true that the home owner will be guilty of any crime...

What, where are you getting this from? At the very least you are being intentionally vague here and eluding to some miscarriage of justice that you heard about.

According to NYS law you are allowed to use deadly physical force against anyone who is committing robbery (against you or a 3rd party), or committing burglary on a premise that you are in control of, or in self defense when you feel that yourself or a 3rd party are in imminent danger of death due to force from another.

Perhaps you are referring to lesser charges such as weapons possession but if that's the case you are being disingenuous with the wording of your story.

The above information comes straight from article 35.20(3) and 35.30(4) of the New York State Penal Law and I'm sure there are a few people on this site who can verify that.

use or threatened imminent use of unlawful physical force; or
(c) The physical force involved is the product of a combat by
agreement not specifically authorized by law.
2. A person may not use deadly physical force upon another person

(a) He reasonably believes that such other person is using or about to
use deadly physical force. Even in such case, however, the actor may not
use deadly physical force if he knows that he can with complete safety
as to himself and others avoid the necessity of so doing by retreating;

(ii) a police officer or peace officer or a person assisting a police

This thread has been hijacked by the lawyers, whereas the gun experts and close combat commentators, not to mention driveway painters, have been relegated to the spectator's gallery. Judge, I am sure you will agree that regardless of the applicable laws, my dead client could have used an Uzi.
