Ima break my lease, tell me what\'s wrong with my gameplan plz.
 
So I moved into a 3 bedroom condo with two girls about 4-5 months ago. I pay $500 per month + utilities.

When I was checking the place out, I told them I was looking to sign a 3-6 month lease. They said we would get the best deal if we signed an 11 month lease. I sort of groaned a bit, saying again how I wasn't looking to sign that long of a lease.
One of them looks at the other and says, "oh, well you can get out of it early."

I look back, and realize she was pretty much talking out of her ass. We all three went down and signed a lease at the rental office. Obviously I can't just go down there and tell them I want out, problem solved. I'm sure their is a cancellation fee, and we would all have to be moving out to cancel, not just me.

So I have a couple ideas, let me know what you think and why they might not work. They are essentially the same but one includes a big sympathy factor for me.

A.) I tell them I'm giving my 30 day notice that I'll be no longer living with them starting Nov. 1st. I pay them the full amount for October. Basically I'm going to tell them that they said I could get out of my lease, so that is exactly what I'm doing. It's up to them to find a new roomate, and it's up to them whether or not to tell our complex what's going on.
If they have a problem with this, I will simply say, "Then take me to court. We had a verbal agreement that I could end my lease early, and that's exactly what I'm doing. Maybe next time you'll learn not tell a potential roomate they can get out of the lease without thinking it through."

Option B is pretty much the exact same thing as A, except I throw in that my father/cousin/whoever is very ill and I'm going to be moving in with them to take care of them. Again, I'll just say that I'm giving my 30 day notice to them, and if they don't like it, I'll see em in court.

These girls are pretty lazy/cheap for the most part, and I don't see them actually forking out the dough necessary to take me to court.

My only real concern is that they could go to the leasing office, and explain to them I'm just leaving, and somehow the leasing office comes after me. This seems unlikely though because we're all on the lease together...all the complex cares about is getting a full check each month.
Not like they will except their amount of rent, and come after me for my portion.

So it seems to me they would simply find another roomate, as that is the cheapest and easiest solution to their new situation.

Anyone see any glaring issues with this plan? Seems pretty solid to me.

You should be able to get out of the lease, especially if you can find someone to take over your portion. If you can do that, its an easy procedure.

If you can't find someone, you should be able to break your commitment, but there is probably a fee. They can't force you to stay there.

Ya, I thought about that, but one of the main reasons I want out is because of their 3 cats. 3 cats makes it tougher to find a roomate, so I just look at all of this as their problem.

no, don't do this.

do you each pay rent individually or does one person pay? if it's the kind of lease where the landlord collects from each of you there is no [censored] chance your little stunt will work because it will be the landlord coming after you, not some lazy cat lovers.

if you haven't been paying the landlord directly there is some chance it will work but the law is still not on your side.

I've been kinda considering getting a roommate moving in with people, and as such have been scanning craigslist a bit. The girls shouldn't have a huge problem finding a roommate unless they're hella picky.

If this post was made next Feb, I'd probably be PMing you. I like cats.

I've thought about just "letting them go outside for awhile" many times, haha.

But now the cats are always in their rooms, so I suppose they really aren't a problem anymore. Except when my roomates are chillin upstairs watching t.v. they bring them up for a little while with them. Then they go downstairs to do something and can't manage to remember their [censored] cats.

The main reason I want to get out is because my dad owns some land in New Zealand and he's offered to fly me out there to just chill for (their) summer.

fwiw I would even be thinking about breaking my lease early if she didn't tell me from the start I could.

One of my roomates pays it directly to the complex with one check.

Everything I pay goes through her. I never see anyone from the management evar. (It's a pretty big place, and the office is wayyyyyyyy down the hill)

it is very likely that if you do this it can end up on your credit report. if the landlord cooperates with them a collection could easily by issued against you as well. this is your fault, suck it up and find a way out or live with the consequences.

I obviously see you point (which is spot on obv), but I'm thinking I can get past that with these two. They aren't they brightest.

That's also why I was thinking of including the sob story about sick family. Perhaps that would push it all over the edge to where they just deal with it. (which shouldn't be too hard as dids said)

1.) They think about how the did say I could get out of it and feel somewhat at responsible to uphold that.

2.) They feel sorry for me about my family member being so sick I have to go move in with them to help care for them.

How/why would the landlord cooperate with them? My two roomates signed a lease with me, which means they agreed that if I skip out on rent, they are on the hook for it just as I would be if they left.

Are you suggesting the complex might tell them, "ok..just give us 2/3 of the rent and we will spend money trying to collect the rest from your roomate who just bailed on you."?

you didn't just sign a lease with them, you signed a lease with the LANDLORD, who will want his money. if they can't or won't come up with it, he will come after you.

if i was them i would agree to pay the rent as usual until a new tenant is found, on the condition that the landlord participates in bringing a collection against you. he's the one who already has counsel and knows how to deal with this. makes sense for both parties.

My point, that I may not have made well, was that it should be plenty easy for YOU to find a repaclement for you. Assuming they'll accept that.

Tell them that you are thinking about moving out in 30-60 days, whatever. Ask if they have any friends or know anyone looking for a place. If not tell them to keep their ears open and offer to help find a roommate off craigslist etc if it comes to that... Pretty simple and happens all the time.

you didn't just sign a lease with them, you signed a lease with the LANDLORD, who will want his money. if they can't or won't come up with it, he will come after you.

I just don't see the landlord bringing a collection against only myself. Let's say my two roomates were to show up at the office with a check for 2/3 the rent, and explained that I just left. The landlord (which is a hudge company btw) will simply see that the full amount of rent hasn't been paid.
It seems like they will do whatever is required to get the money they're owed. The best way to do that is to put out collections on all of the tenants. There odds of getting the money are much greater with 3 people on the hook instead of just one.

To take this one step further, I could easily call the complex and say that I'm out of town but I gave my roomates the (x) months rent in cash before I left, and they obviously don't have their portion so they're trying to dump it on me because I'm out of town. (I would never actually do this, but if I'm playing hardball with my rommates I could pull crap like this out)

I'm not saying you're wrong...you may be dead right, but I'm just trying to think of all possible angles here.

I guess I'll just act like it's no big deal that I want to move out because they told me I could cancel. Hopefully they just say ok and we all move on.

If they give me flak I suppose I'll need to start searching for a replacement.

I don't understand this at all-

your roommate said you could get out of it early (meaning they'll cover you or else they'll get another roommate I think)

Maybe she was full of it or maybe not but why don't you bring it up to your roommates? "Hey remember how I said I wanted to move out early? Well my dad needs me to help shear sheep in new zealand this winter"

It seems like you're not thinking rationally about this at all - you're just trying to come up with ways of being passive-aggressive about the whole situation. If you're honest about the whole thing and she reneges on the deal then it makes her look stupid. If you make up all these ridiculous lies then it makes you look stupid.

Edit: meh in the replies since I started typing this the first time you seem to have come back to reality a little bit. It is all going to work out just fine.

I can understand how I came of as a douche in this thread, but trust me when I tell you they like me. Just the other day I killed a spider for one of them [img]/images/graemlins/grin.gif[/img]

Implying that I'm a scammer for all of 2p2 to read isn't cool at all. I hope you see why.

I never scammed anyone out of any rent, nor do I intend to.

I admit to being lazy as hell, which is why I would prefer if they just find a roomate themselves since they told me I could get out of the lease, but I never once said that I would just not pay them the rent if it came down to it.
