I was always uneasy about the facebook terms of service, which allows them to own and sell any information you put on there.
link They are injecting ads into personal conversations, so it could be something like 'hey hope you had a good time at the beach...REMEMBER TO BUY MEGACORP SUNBLOCK...tell Jenny I said hi" Also, remember how they own all your pictures? They are selling them to companies to use in ads: "For example, if a friend has booked a vacation on Travelocity, the online travel agency will be able to display the friend's photo as part of a "social ad" to entice the user to buy flights and hotel stays. Advertisers can similarly have their pitches appear when friends review restaurants and buy books or DVDs." Companies are now going to be making facebook pages and advertising based on targetted friend groups. Etc, etc. |

I don't post any pics, but my gf posts entire albums and lots of my friends post pics of me so I basically have no control over that unless I ask them to take it down. My best friend is also promoting his music on facebook...and facebook owns all his videos now, I'm pretty sure. |

Uhh, well, this is serious biz. The majority of facebooks members probably didn't know their pictures were going to be used by facebook in this manner, and unless facebooks terms of service, clearly, convincingly and most of all BOLDY stated these terms, I think there is a strong argument to fight it. Reason being, that for most contracts to be valid, both parties must know what they are agreeing to, and in a case like facebook, it can be easily proven that most people did not belive they were signing up for that. Because of fraud, and the era of standardization where a consumer expects to be signing a certain contract with certain terms, this is no longer and era of, you signed it you agreed to it.
I think this is a great opportunity- if facebook decides to pursue its plans- for another website to surface like facebook that previously did not have an opportunity. |

Not a lawyer but what if as a solution to the friends posting photos/videos of you problem you clearly state that any photos etc containing you that others have taken are allowed to be used but their use is non-transferable, therefore facebook cannot put them in ads or whatever.

Yes I know that. However no one can give permission for someone else. So while any photos of me are fair game, photos of my friends shouldn't be.
Except I would assume by default they are as when you upload, you agree you have consent to do so etc... However, if my friend only grants consent to me to display the media and declares the consent nontransferable, facebook cannot touch it. no? |
