Iran immigrant faces deportation

Legal resident has '95 sexual battery conviction

Professional poker player Shahram "Shawn" Sheikhan, an Iranian citizen who lives in Las Vegas and owns several businesses, is facing possible deportation over a 1995 conviction on charges of sexual battery and annoyance or molestation of a child.

Immigration officials arrested Sheikhan at his Las Vegas home on Aug. 30, according to documents filed with the U.S. District Court in Las Vegas.

He was held for more than a week at the North Las Vegas Detention Center before being released on a $10,000 bond.

Federal authorities said they're looking to deport Sheikhan because of the 1995 misdemeanor conviction in Contra Costa County, Calif.

"This individual was targeted for ICE arrest because of his criminal history," Virginia Kice, a spokeswoman for U.S. Immigration and Customs Enforcement, said in an e-mail message Wednesday. "ICE has an ongoing initiative called Operation Predator targeting individuals, including foreign nationals, who prey upon and sexually exploit children."

Kice said immigration officials believe Sheikhan's conviction is "a deportable offense, but ultimately it will be up to an immigration judge to make that determination."

"We want to see him removed from the United States," she said later Wednesday.

Sheikhan, a 38-year-old legal permanent U.S. resident, declined to comment through his lawyer, David Chesnoff, on Tuesday. But Chesnoff said Sheikhan is fighting deportation.

"We're going to do everything in our power to prevent this," he said.

Chesnoff said he also is considering "revisiting the California case based on constitutional issues, including ineffective counsel."

He wouldn't comment on the specifics of that case and did not return a call seeking further comment on Wednesday.

Sheikhan served nine months in jail and five years of probation for the 1995 conviction, immigration officials said.

Sheikhan is known for his sometimes confrontational attitude at the poker table. He reached the final table at the 2005 World Series of Poker main event, where he verbally sparred with another player, Mike Matusow.

Sheikhan owns six local Diversity shops that sell tattoos, piercings, clothing and other items.

He was born in Iran but came to the United States when he was 9, according to court documents.

He has been a legal permanent U.S. resident since 1983, is married to a U.S. citizen and has a 9-year-old daughter.

Sheikhan and his wife own a home in the Canyon Gate Country Club, near Sahara Avenue and Durango Drive, according to Clark County Assessor's records.

Court documents indicate that the U.S. Department of Homeland Security believes Sheikhan is "subject to removal from the United States" in part based on a section of the Immigration and Nationality Act that allows deportation for conviction "of two crimes involving moral turpitude not arising out of a single scheme of criminal misconduct."

He also was involved in a fatal car accident where the other driver, an old woman, was killed. No criminal charges though.

this is ridiculous. he served 9 months in jail and 5 yrs on probation. now, 7 yrs after the probation ended they want him deported? so why did he do hard time? i thought that when you were released from jail you were a free man...guess i was wrong?

Are you sure its legitimate child molestation and not something like Statutory rape?

I'd wait to pass judgement until I know the legitimacy of the crime.

Either way deportation should have been done or not done at the time of the conviction.

the law is bullsht (imagine another crime if need be). He could of been deported when immediately after serving his prison term but he wasn't.

Now under the guise of Homeland Security he is being unfairly targeted for deportation and arrested many years later for no apparent reason.

He has served his time and was deemed fit to stay in the country. He has been a productive citizen since then, therefore he shouldnt be frced to leave now. Retroactively punishing people is a bad precedent to allow. It might lead to all kinds of issues down the road.

With that said, I have no issues with OJ not being able to get anywhere close to a fair shake in the current legal issues.


Oh and the old lady he "killed" was 90 yrs and it was the result of a car accident on a rainy day. Vegas people arent to good with driving in the rain.

9 months in jail is a lot for a misdemeanor, where the max time is generally 12 months anyway. This suggests that he must have done some pretty nasty stuff - perhaps felony charges were plead down to a misdemeanor?

W/e, was this girl like 17 or something? 9 months is a decent amount of time served. They shoulda deported him when this all happend (if all of it is true of course)

He must have pissed off someone recently and they were mad enuff to call the authorities this time.

This doesn't sound like the language for a 17 year-old girl. Could have been like a 14 year-old girl and plead from statutory rape. Sounds like probably plead down from child molesting of a little girl.

If he plays in more tournaments, it will be harder for him to mouth off, as he won't want to hear about this.

I wouldnt necessarily call him a child molester - the fact that it was a misdemeanor crime leads me to believe that this possible "annoyance of a child" charge could have been something along the lines of slapping a 15year old on the butt or something. I dont know, and without some specific knowledge, I'd suggest not calling a man a "child molestor."

This is BS, no matter what the actual circumstances of the misdemeanor were. He was found guilty by the court, and he served time in jail and probation. THAT'S IT, it's over. You can't go arrest him over a decade later and say "oh wait, now we wanna deport you for that crime you were already punished for."

No, it sounds like a politician or someone at DHS is trying to get their name in the headlines to advertise how their so "tough on crime" in order to advance their career. Probably using some draconian law that was passed following 9/11.

This will be an interesting case. Sheik has a really good attorney.

How do you think ICE determined to go after Sheik after 12 years have passed ? It searches through old court records looking for someone to deport for two crimes involving "moral turpitude".

Keep in mind this fell under the Department of Homeland Security. Think Sheik's ethnicity had anything to do with this prosecution ?

Keep in mind also he is in the US legally, is married, has a daughter, owns a home and owns successful retail businesses.

Would a misdemeanor charge be a deportable offense for other underlying conduct ? What if the charge had been smoking pot or, online gambling ? What constitutes "moral turpitude" ? Is the crime, comitting an act of moral turpitude while being Iranian ?

I cannot stand Sheik, but where is the line drawn .... is it an open ticket back to wherever to get a misdemeanor ? Will this mean "legal" immigrants of Iranian or Arabic descent who get two misdemeanors can be deported ?
