The probability of Seif following through on his thinly veiled threats are slim, very slim.

I see saber rattling like this all the time from the executives of penny stock scams.

They never follow through, mainly because the accusations are accurate, and when they do they are nearly uniformly laughed out of court.

Witteles has made several false claims and he continues to do so... I believe very strongly that he has knowingly and intentionally or with reckless disregard for the truth ... made at least one statement that makes a false claim, expressly stated or implied to be factual, that may harm the reputation of an individual, business, product, group, government or nation.

Excuse me, Mr. Seif, sir. I believe you may have dropped this veil.

That's pretty much how it comes off to me too. Seif has no real defense here and he knows it, so now he's just making his empty, baseless little threats in pseudo-legalize (as if he's ever suing anyone). Also, since Seif wants to put his attorney hat on, one of the defenses to slander and libel is if the statements in question were actually true...

This guy comes off more and more pathetic every day, and it's only getting worse. I don't know if it's going to ever be shown that he's a thief or participated in the cheating in some way, but he's already been shown to be a scumbag liar and that's good enough for me. Zero credibility.

Warning: This message contains one or more bad poker analogies.

Remember that not everybody who brings a suit to court does so with the intention or expectation of winning a judgement. They may hope that the cost of mounting a defence will deter the respondant from defending. It is sort of like a big stack bullying a short stack, hoping the short stack will not call.

Alternatively, Seif may think that his reputation is so badly damaged that the only hope he has is to mount a civil suit, despite the noted problems for AP. Perhaps so much of his rep is already in the pot that he is calling the turn all-in, hoping to hit his one-outer.

Your analogies are bad. He doesn't have a one-outer. He's drawing dead.

Is Seif on drugs?

For his sake I hope so, otherwise there is no explanation for the strategy behind his communiques beyond a clear attempt to whitewash everything.

I mean, WTF, he would be better served by remaining silent until the so-called audit reached a conclusion. What's that line again? It is better to be thought a fool than to opening ones mouth and remove all doubt.

Obviously his ego is grossly inflated and cannot handle the constants attacks on his character without punching in with what he hopes, incorrectly I might add, is the proverbial last word.

Precisely the character type of someone who might have a brief lapse of good judgment and resort to cheating in an fool-hearted attempt to protect the ego. "Oh yeah, you think you're so good and I'm so terrible? I'll show you whose boss around here. Who's laughing now?"
