Number One was to never, ever, ever, ever, take a breathalyzer if you have even a 5% chance of failing. In MA it results in automatic license suspension to refuse, but you'll get that anyway plus it gives them a lock when it comes to court down the line. Obviously I don't condone drunk driving, but anyone here who doesnt realize that 90% of people leaving Italian restaraunts are over the legal alcohol limit from th wine are kidding themselves. Nobody advotes not serving wine with dinner. |

Wow, everyone on this board is perfect. The OP made a pretty good job at explaining how he knew it wasn't smart to drink and drive, and all you guys can do is tell him he's a [censored] idiot and HSSKH. It's good to have people like you guys around who don't make any mistakes.

Just in case anybody cares, I thought I would give an update on my situation. After speaking with a lawyer, I found out that refusing the breathalizer turned out to be the best thing I could have done.
The particular county I live in offers something called a WHIP Refusal program for 1st time offenders that didn't blow. It works something like this. I am required to take a 36 hour weekend SATOP course which will allow me to not lose my license whatsoever and the charge will be taken completely off my record. It will be just like it never happened. Yeah! Bad news is that after the lawyer fees, SATOP class, and fines, it's going to cost me about $2000. Hopefully this will teach me my lesson. |

I have 2 duis that cost a total of around 10K...I still drive drunk occasionally. Im probably just an insane alki but i know for me money didnt change sht

Im glad you're getting off. Driving drunk is fun and I think it's pretty unlikely that youd run over an 8 year old girl on the side of the road in the middle of the night. Don't listen to all these losers crying about people getting killed by drunk drivers. People die everyday, it happens, they need to stop whining and deal with it.
