Not surprising (but still disappointing since I sent him several letters/emails) my rep voted for the bill. I look forward to voting for his opponent in the election.

The constitutionality of this bill will be challenged within 24 hours of its passage in the Senate if it gets that far.

[/ QUOTE ]

Why is this bill unconstitutional?

[/ QUOTE ]

I will take a guess and say because it is too broad in scope. If it was something specific like banning underage gambling it would be fine.

But simply telling the public what they can or cannot do (when it is legal in other forms elsewhere), is a bit of a stretch.

[/ QUOTE ]

ISPs or ACLU or the like will challenge its constitutionality on the grounds that it restricts personal freedoms, but is not sufficiently narrowly tailored to achieve its objective -- cliff's notes: it's overinclusive / too broad. We might hope that a court issues a stay on its enforcement while it's litigated.

I don't think even if it passes the Senate it will go through.

There should be a challenge in the courts on right to privacy. This is a blaring example of gov't intrusion and should be challenged.

Could be a 2-3 year battle

[/ QUOTE ]

Instead of indulging yourself in these fantasies of why the bill won't ever become a reality even if the senate does pass it, why not call/write your senator so it doesn't even pass in the first place?

[/ QUOTE ]

I'm sorry, but people are tired of receiving automatic form replies from the Congressman.

Do you really think there is any politician in this country who is not already aware of the acceptance and popularity of inline gambling?

There's a commercial on TV every ten minutes.

If for some strange reason they honestly didn't have a clue yet, a million emails wouldn't matter.

And do you think that will be enough to get this bill overturned?

You guys who think this will get held up in the courts or declared unconstitutional are seriously mistaken. I think of a single plausible argument that would get this shot down in the courts.

[/ QUOTE ]

A lot would depend also on how a challenge is brought and what happens in the mean time. If the law goes into place for 2-3 years while it is being challenges, the online poker boom would be squashed and hampered forever IMO.

Just call your Senators and urge them to not take action on HR 4411 or companion legislation.

Please tell us the difference between online gaming and casino gaming.

Regulation? Fine, implement regulation, but it's going to be one hard azz pill to swallow a complete ban.

Among people who actually vote, instead of, say, spending election day at the Trop... yes, I think most of them are unaware.
