And keeping in touch with him so he licks his wounds is retarded - especially given that he has been unavailable. If he does not respond shortly and an agreement is reached then a lawsuit will be filed. What he has done is wrong. This guy has taken away income from people who actually need it. Not everyone under him was a college kid who the money was just some extra cash. As affiliate yourself I would hope you would support cleaning up the garbage affiliates and setting a precedent that you can't screw over your customers. Telling people to just move on puts your character in question in my book. |

blood out of a turnip comes to mind. it is not in your best interest to continue to look back and try to get money from someone who doesn't have it anymore. the chances of tim having enough money left to pay people is very remote.
the only way to get anything at all is to find a better deal and move forward. you are not going to start some class action suit and get him to pay you. the cost of litigation is way more than the money he ever had! yes it is sad and bad that he did what he did, but learn from it and try not to make the same mistake again. |

[/ QUOTE ]this is horrible horrible advice... you think he has spent over 100K in the last month? he is still recieving income. there is no reason to believe he income has done nothing but increase several times over since dropping his rakeback deals. before he kept a couple percent from people's play now he is keeping 25-30% or whatever. so he his player base would have to have been cut by a factor of 10. that has not happened. i am sure a ton of players stuck with playing at party poker through the accelerator bonus at least, which just ended a week or two ago. also, if you think the vast majority of his players closed their accounts and withdrew you are sorely mistaken. i wouldn't be surprised if a lot of the high rakers did so (i did) but i can't possibily imagine all these things resulting in anything but a net increase in income over the last few months. and a very large increase at that. EDIT: not that you would admit it, but are you affiliated with tim in any way? it seems like you have made several posts that seem really strange. i am guessing you don't understand the story well (none of us, other than tim perhaps, really know the whole story since we can't see his books) or you haven't spent more than a minute's thought on the posts you've made or you have some sort of motivation for wanting tim to come out clean on this one |

as i tried to do something to help i realized that it is impossible to tidy this mess up without getting banned by party. there is zero way to give people rake back on party poker and that is the only thing that they want.
i agree with them...i wish party allowed it. i think what tim did was very poor business, but that money is gone. he is not making a killing. just one thing about contract law that hasn't been discussed here. it is not possible to enforce an illegal agreement. tim would argue that party poker disallows rake back, so any agreements you had were unenforceable. you can not hire a prostitute and then sue her for not putting out. it is illegal (most everywhere) to have sex for money, so you can't enforce a contract for sex for money. it is illegal to sell drugs, so you can't take a drug dealer to court for selling bad drugs it is illegal to do rakeback on party poker so you can't take an affiliate to court for not doing it. does that help? i am not saying he is a good guy, and i am not justifying what he did. it is just reality. |

i don't know for sure, but someone said that party poker closed down his account, and he isn't collecting now. surely that is one thing that the group can do is make sure party does close him down!
