Do you know anyone who's gotten off by anything other than luck? Do you see movie stars getting their charges dropped? Sports figures? If they can't everytime, you think it's anything more than a lucky fluke that will get joe shlub off?

On my DUI they didn't process it for almost a year. I seriously thought it was lost in the system. But the lawyer would have had nothing to do with it. I think it's definitely worth getting a laywer to make your life easier and maybe find some technicality. But from everything I've heard, spending a lot more != much better chances of getting off.

Just got back from taking a five minute trip to the store last night when some cop pulled me over b/c I had mud on my lisence plate. It was my dad's car and apparently if a 20 yr old is out at 11:30 driving a BMW its stolen, so after pretty much accusing me of jacking my dads ride she followed me home and woke my parents to question them as to why I was out at the time I was driving a higher end car, apparently ppl dont drive to the store unless they own a beater. So after about 15 min she said have a good night to which I said "thank you for wasting my time in the name of public "safety".

I know several people that have gotten off. In my experience it's more about having friends in the prosecutor's office/police department/court system. The reason it doesn't happen with pro athletes or celebrities is that they are way too high profile. The press would catch wind of it and anyone who did them a favor would have hell to pay.

If you had the license, registration and insurance for the car on you and she did this please report her actions to her supervisor. No reason for her to think you stole the car from your parents unless they reported the car was jacked.

Moral of story: If you have had ANYTHING to drink within the past few hours, drive the speed limit and avoid getting pulled over alltogether.

I agree with op about rights being violated because of a similar incident over the 4th of July.

Minnesota has tons of lakes and I was partying it up in a town called Detroit Lakes. Anyway, was planning on staying with a friend but he didn't realize how many relatives were at his cabin so after I had been drinking a few hours he told me I probably couldn't stay. I stopped drinking and go the next 2.5 to 3 hours without drinking & chugging water while looking for other options in case I didn't think I could drive yet. Never found anyplace else to stay so i drove home, about 45 miles away. The road home goes through a bunch of little towns. I stop in one about 6 miles from home because I had to crap. Left the store and went a few miles. While at a light I realized I kinda had to crap again and didn't and didn't wanna risk trying to make it home again. I knew there was a gas station on my right so I pulled in but it was closed. Did a U-turn around the gas pumps and left going the way I originally was. Get pulled over by a cop who was apparently staking me out. Asks why I went into 2 gas stations within a couple miles. I say diarrhea. Have to take the field breathalyzer and fail. While this is going down, I ask why I got pulled over. He says "suspicious vehicle". No swerving, no traffic citations. Complete and total b.s.

Innocent til Proven Guilty? I lost my license in MN until we get through with court.

Weird: I actually was on a no carb diet too and although I was tired from being in the sun all day felt under the legal .08 limit. I hadn't had a drink for at least 2.5 hours. I have done some research into this and found out that these diets increase the acetone levels and can screw with breathalyzer readings because of this.

Oh, I did an English paper on whether or not Minnesota should lower their BAC to .08 right around the time it was to be enacted. I can't remember the exact figures but something like 96% of all alcohol related accidents involve someone with a BAC of .14 or greater. It's total B.S. to lower the law unless we are starting to attack the social drinkers. This does nothing to help the situation. Lowering it IS MADD's way of trying to instill prohibition on alcohol in America.

If you didn't know that the cops around DL/Alex (or the entire state, really) would be out hardcore on the 4th, that's pretty ridiculous. I spent the 4th in St. Cloud and wasn't going anywhere NEAR my car after my first drink, just because of the atmosphere in town.

Your rights weren't taken away. You had been drinking and partying and decided to drive when you weren't sober. Where are you from? 45 miles from detroit lakes is a decent little hike when you've been drinking. I've also never heard of "no carb" diets screwing up breathalyzers, but I'm not going to go looking up stats. If you'd like to, you're more than welcome.

Pulling U-turns through closed gas stations at night, sadly, is a good way to get the attention of any police around. You basically walked right into the perfect storm. Sucks, but that's the breaks. I've read that the average male processes alcohol (lowers the BAC) by about .01 per hour. Its very possible that if you'd had enough drinks your BAC was still going up during those 2 hours.
