Wow, you have a twisted way of looking at it. Gee, what is the magic number at which it becomes okay for Gold to default on his obligation?

In my book, you can't make an agreement with someone and then wuss out later because it would be advantageous for you. I hope Gold loses this case and pays the guy what he owes him.

If Leyser has taped phone conversations that either Gold admits is his voice (or are proven to be Gold) and on these conversations Gold continues to assure Leyser not to worry, that he (Leyser) will get half of whatever Gold wins. Then IMHO Leyser is a stand up guy and Gold is a creep.

We haven't heard Jamie or Jamie's people say that he (Jamie) does not intend to pay Leyser.

What I took from the PR statements was that Jamie wanted to settle the matter with Leyser without bringing in legal representation.

I never got nor do I have the impression (for the time being) that Jamie intends to stiff the dude.

I think we should wait and see how it plays out before we add this as another nail in Jamie's public opinion coffin.

Answer: the law of contract. If the contract was that they split any winnings 50/50, then the contract was that they split any winnings 50/50. They both knew that the there was a potential to win $12 million. If you ask me, Gold is a complete f9ckign idiot for making this deal. Your reaction is a common sense reaction - the consideration by Leyser for the contract - getting a couple of D list celebrities to wear Bodog shirts - does not seem sufficient to get him a $6 million dollar payday. However, if that was the deal, then that was the deal. And Gold is an idiot for making a bad deal.

Just listen to Gold's radio interview and you will be routing for this guy to lose in the courts. Total douche.

One obvious possibility is that Jamie Gold has some lawyers trying to cook up legal arguments as to why Leyser is entitled to something less than 1/2 the winnings. Another possibility is that they were just working out the tax ramifications of the whole thing. However, Lesyer filed a freaking lawsuit for chrisake. He obviously did not feel warm and fuzzy about Jamie Gold paying him his money. So far, it looks like Gold wants to pay Leyser something less than 1/2 or nothing, which is a total douche move. Gold may think its worth a shot to contest the contract in court. He obviously doesn't realize that when people sue each other, generally no one wins but the lawyers.

The "irreparable harm" phrasing is a legal term of art that is a condition for granting an injunction.

As far as I can tell, Leyser got paranoid because Jaime Gold wanted to structure the payment of the winnings to avoid paying full tax liability. Even assuming Gold promised half the winnings to Leyser, Gold hasn't done anything yet to indicate he intends to breach the deal.

My understanding is that Gold was waiting to cash in so that he could set everything up to claim prize money in the most tax-efficient manner then Leyser became impatient (not that I would be patient with that much money at stake with someone I hardly know).

Also, I am still unclear as to why Jamie Gold ever promised half of his winnings in the first place.
