UPDATE- Per my lawyers request the arraingment was post-poned till May 8th. My lawyer wanted 2 months before entering a plea. Reasons why he took this approach.
1) Wants to review all reports and have strong argument when he pleads not guilty 2) Wants to get full service records for the arresting officers and wants to get calibration reports for the machine 3) Believes that after two months, the story of the CHP officers (who make several stops a night) might begin to change and contradict the actual events [making their statments easier to impeach] 4) With a two month delay there is always a chance that important paper-work will be over-looked, miss-filed, lost, et. al. and would result in an immediate dismal at arraignment. this lawyer seems like he's on it. |

Not that your opinion really means crap to me... but if you really think I'm one of America's most wanted... you need to get out of your suburbanite cacoon once in a while. Technically... i broke the law... I agree with this. IF the penalty fit the crime... i wouldn't be wasting $3,500 on a lawyer and getting ready for a six month legal battle. HOWEVER, due to the fact that a first offense DUI in CA carries a $1,000 penalty, 6 month suspended license, 1-3 years probation, about a 30% increase to my car insurance, AND an AA class (20-40 hours)... I'm willing to fight the system. |

are there really people who think it's ok to drive drunk as long as you don't hurt anyone? is it ok to shoot a firearm in public as long as the bullets don't hit anyone?

If I had blown a .20%, been out drinking in Hollywood all night, whatever... I wouldn't be looking for any support or advice. But the key here... is that I wasn't "DRUNK".... if I was exhibiting any signs of "drunkness"... I'm 100% sure that would have been the officers first question when she originally took my license and registration for the speeding ticket. |

She was probably fishing anyway - it was after midnight, you were presumably heading home from some bar, etc. I've heard that cops are very good at spotting and smelling booze, but if you had said "no, I just left my office" there was a reasonable if not very good chance the conversation would have ended there. I love the TV show Cops, and I never fail to be amazed at how many people are on the verge of being let go by a cop and then admit to having a few beers, or say something like "I've got nothing to hide, you can search my car"...and it's Whammo! What's this? Why it's a huge bag of drugs! If you're breaking the law, or not, never tell the cops anything. Don't try to talk the cops out of anything, don't argue, don't admit shhh-it. Sorry, I kind of went to tangent land. Yea, get a lawyer, fight it, your sure to get it reduced to less than DUI status. |

But I think the point he was trying to get across was that we can be a preventative law / prohabition type society. If that's the case... we would lose all individual rights. The pendulum has already swung to far back the other way... I think that's the point he was trying to drive home. |
