This is exaclty why DA's should not be elected. Many of them don't give a sh1t about the ordeal, humiliation, and huge expense that innocent defendants have to go through. All they care about is being tough on crime and getting elected.

I hate sex offenders more than anybody and feel they usually get off way to easy, however there needs to be serious consequences for false allegations.

I know it's a tough act to balance, you don't want to discourage real victims from coming forward, but you can't have it so they get off scott free when it's proven 100% they are totally lying.

Rape cases are very difficult, just due to the fact quite often it comes down to the "he said, she said" nature of them.

Normally the guy claims it was consentual.

In this case, where there isn't even DNA proof they HAD sex I don't see how in the heck you can prove rape.

I'm trying to keep an open mind. I don't want to be accused of a reverse OJ thing here and be accused of blindly thinking they are innocent despite the facts, however unless we start hearing/seeing some actual evidence other than just her words it looks pretty one sided.

This is tough because very few rapes are reported as is. Imagine something worse than being raped, accusing rapist, then being tried for lying when it really happened. This case is just ugly all around. This DA is really the guy that looks bad now. Whether she is lying or not, it really seems like there isn't much of a case after this alibi came out. There is going to be bad blood in that community for a long time as a result of this whole thing.

The fact she is a stripper and was apparently legally drunk during her entire time in the house completely ruins her credibility, regardless of whether or not she was raped.

The creditibiltiy of the alleged victim in a rape case is ALWAYS an issue, even when it shouldn't be.

Had this been some Duke honor student making these accusations people would take them alot more seriously.

People assume that unmarried strippers who have two kids and are drunk are alot more likely to make up crazy B.S. and that's pretty true.

Of course that doesn't mean it didn't happen, but I'm seeing almost no chance of a conviction and less and less chance of even a trial at this point.

The DA probably doesn't want to look like he's backpeddling.

Regardless the whole media circus atmosphere around the case has been sickening, on all sides.

I don't see how this gets even close to a conviction. If the DA wasn't up for re-election soon and getting considerable heat from the outside then he would have already thrown this out. The only reason this is still a case is because of the media and other political pressures.

Think about this...This girl just identified 100% that Lax Player A raper her. Yet, Lax Player A was only at the party for 20 minutes. Double match point for the Lax players.

At this point, I can't imagine even Sharpton thinks this woman was actually raped by these kids.

When the charges are dismissed, I wonder what possible recourse these kids will have against Duke for suspending them from school causing them to lose a semester and presumably $20,000 in tuition.

Colleges leave themselves lots of outs.

The fact they hired a stripper and had *GASP* alcohol at a college party is enough for the college to suspend them for according to the rules and stuff I'm sure.

Quick question: So the two guys posted $400,000 bonds after their arrests. If it turns out that they're innocent, do they get this money back?

Yes, actually they'd get it back even if they are convicted.

Bond is pretty much a deterent from running away I believe

If you flee, the gov. gets the money.

Since your word can't be your bond, your money is your bond, haha
