I do agree with what a few people are pointing out- that reading the T&C, Party is probably not LEGALLY liable to pay out the full $14.5, $16, or $24 Million (depending on how you calculate it.)
That doesn't make it "fair" or "right". If someone is not under any legal obligation to honor their promise or verbal guarantee that they will take care of their customers, it does not justify nor make it right reneging on a promotion. Microbob's right, being outside the US is not really the point. When was the last time a land-based casino ran a multi-million dollar promotion and then decided to only pay out 25-50% of how much the promotion was advertised / touted to be worth? It's unethical, and it's bad business because they are not going out of business (yet), but they are going to give their remaining customer base something to think about. How much do you think European players will trust Party for the next big multi-million $ promotion if we manage to get the fact that Party kept millions of $s in rake promised to players? |

[ QUOTE ] Dear XXXX, Unfortunately, the structure of the PartyPoker.com Monster made it untenable to continue with the tournament once the act became law, and it was discontinued. We have converted pending Monster Freerolls into equivalent cash amounts. If you had any unused Monster Freerolls, you can log in to your PartyAccount to convert them into cash and see how the amounts were calculated. We came up with what we thought was a fair and equitable distribution for each unused freeroll. Thus the determined values of the monster freerolls will not be changed Praful PartyPoker Customer Care [/ QUOTE ] [ QUOTE ] I am not interested in your opinion,I want the players to get back the money they paid into this promotion, not have you keep $5-10 million extra. Forward this to a manager as I requested, I am not interested in an answer from anyone else. If the money is not distributed fairly, I will make sure that poker magazines, Casinomeister (online watchdog) and Gibraltarian gamingboard will be made aware of the scam you are running. [/ QUOTE ] Party are scammers and cheaters, and if that is not enough, they are stupid. ToT |

[ QUOTE ] As I said in the other thread - Party is based out of the States, so "Guaranteed" is a meaningless word. If by some miracle online poker becomes U.S. regulated and taxed in the future, you'll be damn sure the poker commission would hold them accountable for such statements. [/ QUOTE ] Actually, I don't think that's a given at all. haven't there been U.S. promotions where the casino pretty much reserves the right 'to change the promotion as they see fit' or something like that and customers end up getting screwed? [/ QUOTE ] Bob the major difference between the scenario you describe and this scenario is that Party collected customer's money. It's one thing to run a promotional $200,000 poker freeroll tournament for your big fish, have only 10 people take them up on the offer and decide to cancel the promotion. It's another thing to fund a jackpot with $9.5m worth of players funds, and then rebate $7 million of it at the end all the while promising the customers $22m in future prizes. Taking back the difference between the $9.5 million dollars and the rest of the guarantees ($like $9m in freerolls and $5m in value added in the finale) is shady at best. Taking the difference between what they rebated and the player funded money is criminal. |

Nice mail Bananaboy. Mike "enjoy" O'malley must be trembling his balls off his body and begging Dikshit on the phone to restitute the stolen money.
Maybe they planned to use them to compensate the many, many poor bastards that must have lost their underpaid job. Nah, most probably management doesn't give a F*** about them anyway... Keep us posted about their reply, in 10/11 months or so... |

So I ended up sending a total of 9, count 'em, 9 emails to Party before getting a non-form-letter reply. Here it is, enjoy!
(My reply follows) [email protected] wrote: Dear xxx, As mentioned in our previous e-mail, we have made an extremely fair distribution to all our players while refunding the unused Monster Freerolls. It is clearly mentioned in our Monster Terms & Conditions that, if the Promotion cannot be executed as planned, including any problems or technical malfunction beyond the control of PartyPoker.com, PartyPoker.com shall incur no liability and prizes will not be awarded. However, keeping all our players in mind, we have gone a head and distributed the Monster Prize Pool to all our eligible players. For more information about Monster Terms & Conditions, please visit the link given below: http://www.partypoker.com/monster/termsconditions.html I am extremely sorry to inform you that, we will not be able to add any additional amount. Should you require any further assistance, please call us at our toll free number 1-800-852-4719. Shashidhar PartyPoker Customer Care Shashidhar, Thank you for giving me the respect of reading my email and answering my questions. I do appreciate that. While Party may have had no LEGAL obligation to pay for the seats, I respectfully disagree that paying $6 Million to players when $15+ Million was "guaranteed" is "fair". I'm sure you can understand how disappointed and angry many of the players who had Monster seats might be at being underpaid for them. Bottom line: Party TOOK nearly $10 MILLION FROM PLAYERS in Monster rake, PROMISED OVER $15 MILLION IN PRIZES, BUT GAVE ONLY $6 or 7 MILLION BACK. This is not treating your customers well, no matter how you spin it. I will not return to Party if they ever invite US players back unless I receive additional money for my Grand Final seats. Thank you, xxx |

I called them, not exactly business hours.
Just met their first line defence, illogical CS. But I will not give up before I get to speak to someone high up and fix this scam. Better shortsell your Party stocks folks, this might get ugly. ToT |

This response from VIP (to a re-re-re-re-send of my email) at least on the surface looks like progress in getting dissatisfaction with the payouts commuincated upward to Party management.
