[/ QUOTE ] You stumbled across another interesting point about why the laws are effed: people who are regular drinkers function "normal" at much higher BAC thresholds than those who are light/occasional drinkers. Take the guy I know who 8+ hours after his last drink was still somehow >.03, despite not being hungover or drunk. From what I've discerned he probably has a problem with the bottle but deliberately never, ever drives after drinking anymore to avoid putting himself or others at risk or to get popped again. As for the "dark road" where they are over the legal limit but can function just fine, are you suggesting that people be punished for having a problem with alcohol? There is NO impeirical scientific evidence that shows a driver is worse of from 0.10 to 0.08... this is just an arbitrary number that MADD somehow got pushed through congress. Currently, several states (including CA) have pending legislation to decrease the amount to 0.05... For those of you who live in states with great public transportation, I envy you. Even more disturbing is that in CA if you blow over 0.01... and the officer feels you are impaired (even if it's just due to fatigue, other physical issues, or just stupidity), you can be charged with a DUI. At that point it becomes an expensive burden of proof with your opinion being argued in court against the officers. |

I had EXACTLY 5 Tanquerey and Tonics from 7 PM - 9:30 PM... went back to work, got busted at 12:12 and blew a 0.09. During expert testimony it was explained that the body CAN process about two drinks and hour and keep you at a 0.00 BAC... but in many people two drinks an hour are enough to take them to the legal limit of 0.08. |

When at a nicer restaurant or bar I suspect that 1 gin-and-tonic would actually be more than 1 drink. People also need to realize that on those calculators that it's only 12 ounces that is considered 1 beer. Many people might have a 16 or 20 ounce glass or mug but continue to think of it as one drink. |
