lol, this is getting funny and sadly lame.

Let's talk about the real potential problem with driving drunk...POSSIBLY KILLING SOMEONE.

So, if under this new line of thinking, if you are in a wreck and kill someone, should the penalty be less because "you aren't that drunk...just a little drunk..."

I'm pretty sure that the dead person is still just as dead.

...Drunk driving laws are enacted to prevent accidents/deaths, not to fit into your definitions or lifestyle.

Ok... so by this line of thinking... and by wanting to have preventative laws...

AND since you acknowledged that you are such a violent-rageful guy that you actually attempted to run a guy into a guard-rail with your car... your license should be suspended, your car impounded, and you should also go to jail... right???

By-Tor, would you be OK with it if I drove for 4 continuous days?

The problem is many, many people at any particular time are not driving as well as they could be. Being tired, having just had an argument with the wife, dealing with losing a friend or loved one, eating, or driving with crappy brakes are all legal. People who don't drive well most of the time include teenagers, the elderly, people with moderate vision problems, people with narcolepsy, etc. All of these people will not drive well compared to a middle-aged well rested control subject. Hell, even having a cold is life threatening if you have to sneeze. Where do you draw the line? Millions of people are impaired in some way.

stopped reading after this. we are talking about drunk driving, not every other conceivable instance that could cause an accident.

Dont cops say "I smell alcohol" every single time they stop someone? I have mixed feelings about this - I hate drunk driving, but I also hate the police.

"5 tries on the breathalizer after 2 goes at a field sobriety test. That is maddening."

For real.

The sad thing is that a number matters and not your physical state. This is stupid. I can't judge whether or not BB was impaired through a post, but passing the field tests should be enough IMO.

Amen to this. The legal limit should protect people against arbitrary arrests, not be incriminating in and of itself.

and the fact that I had a full and coherent conversation with the officer about my speeding and my registration prior to her even asking if I had been drinking.
