1) Jack was more aggressively gay the entire time, whereas Ennis seemed to repress his own feelings to a much greater extent. So I'd say Jack knew, Ennis didn't.

2) The gay bashing death is Heath Ledger imagining what really happened to Jack. The tire iron beating, similar to how he described the old men getting beaten to death in his childhood, kind of gives that away. But Anne Hathaway's rehearsed tone does leave the question open as to what really happened.
