[/ QUOTE ] Nothing, as yet - however, both IR and suspension may supercede the clause in the CBA about 35-year-olds, etc., etc. I think it's a very gray area - if I were New Jersey, I'd pay Malakhov $500K under the table to stay home in Russia if that would get him off the cap - he doesn't want to come over and live in Lowell for 7 months. Same thing with IR - teams could just IR players who they didn't want to have on the cap. It's rumored the Devils are seeking a second opinion on Mogilny to be sure he is not fit to play. |

Mogilny's salary might count against the cap because the "injury" was probably from playing in the minors last season... if so they have to take the cap hit.
Malakhov is suspended by the Devil's... some are saying if a suspension carries over to the next season it's a breach of contract. No one knows for sure though. |

[/ QUOTE ] The NHL will have a very hard time and a very gray area if they wish to enforce this thing about Mogilny getting hurt in the minors. He had started to miss games in the NHL before getting sent down and had a pre-existing condition in his hip - it's pretty clear that it didn't happen in the minors. He was already two steps slower in the NHL when he came back with the Devils. Haven't heard that about breach of contract - glancing through the CBA, it actually looks possible. However the clause is very ambiguous - 'The club may terminate the contract (obtaining waivers from all other teams)...if the player shall at anytime fail, refuse, or neglect to obey the Club's rules governing training and conduct of players, if such failure, refusal, or neglect should constitute a material breach of this contract.' Now looking through the Standard Player Contract, he is supposed to report to his Club's training camp at the time and place fixed by the Club. It appears that the same clause I quoted above is written into every contract about breach of contract. It's just never applied since an arcane rule such as this was never in place - if a guy didn't show, the team didn't terminate his contract since they didn't have to pay him anyway. However, the league may feel that its rule is toothless if this comes about - and I don't know what Waivers from every other team means. |

New Jersey deals Malakhov to San Jose with a 1st for Fahey and the rights to Korolyuk - never thought San Jose would be interested in keeping dead weight on their cap, but then again they can just deal him later in the season.
Good deal for both sides - not surprised it took a 1st to make this work given how late in the 'off-season' it is. I wasn't sure the NHL would allow it, but given Malakhov's status (not retired, under contract) it seems perfectly fair. |
