Did you do this deliberately to get hi to throw it away? With a straight on the board (and you not having a higher straight) this statement is perilously close to an angle. If you said this to him in confusion, implying you had a set beat, I'd say there was a strong moral case for giving him his money back. And if you did this deliberately, it's a pretty scummy angle.

Technically, of course, you are entitled to keep it as everyone else said.
